Welcome to HireAVac. These Terms of Use ("Terms") govern your access to and use of https://hireavac.com (the "Site"), our online quote and booking tools, and any communications you have with us by phone, email, SMS or WhatsApp. By using the Site or requesting a rental, you agree to these Terms. If you do not agree, please do not use the Site.

Equipment rentals are governed by a separate written Rental Agreement signed at the time of delivery, which controls in case of conflict with these Terms.

1. Eligibility

You must be at least 18 years old and authorized to bind your business to a contract to request a quote, book a trial or rent equipment. By submitting a form you represent that the information provided is accurate and complete.

2. Use of the Site

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable federal, state or local law.
• Attempt to gain unauthorized access to any portion of the Site, server, database or related systems.
• Use any robot, scraper, or data mining tool to extract content without our written permission.
• Interfere with the Site's security, availability or proper operation.
• Submit false, misleading or fraudulent information.

3. Intellectual Property

All content on the Site — including text, graphics, logos, product photography, case studies, blog posts, videos, software and the HireAVac name and logo — is owned by HireAVac or its licensors and is protected by U.S. and international copyright, trademark and other intellectual property laws. You may view and print content for your own internal business use related to evaluating or using our services. Any other use, including republication, redistribution or commercial use, requires our prior written consent.

4. Quotes, Pricing and Availability

Quotes are estimates based on the information you provide and are valid for 14 days unless otherwise stated. Final pricing, equipment availability, delivery windows and required accessories are confirmed in the Rental Agreement. Specifications, photos and performance figures on the Site are provided for general reference and may change without notice as manufacturers update their products.

5. Free Onsite Trial

Free onsite trials are offered subject to availability, geographic eligibility and reasonable site access. Trials typically last up to 60 minutes and are conducted by a HireAVac technician. You are responsible for ensuring a safe work environment, appropriate PPE, electrical power and any site-specific permits during the trial.

6. Compliance and Safety Information

We share OSHA, EPA, IICRC, ICRA and similar regulatory information as a courtesy to help contractors select appropriate equipment. This information is for general guidance only and is not legal, engineering or industrial-hygiene advice. You are solely responsible for confirming that your work plan, exposure controls, PPE, waste handling and recordkeeping comply with all applicable standards, including OSHA 1910.1053 (respirable crystalline silica), OSHA 1926.62 (lead in construction), EPA RRP §745.85, NESHAP asbestos rules and any state or local equivalents.

7. Disclaimers

THE SITE AND ALL CONTENT, EQUIPMENT SPECIFICATIONS AND RECOMMENDATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HIREAVAC AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY FOR ACTUAL RENTAL TRANSACTIONS IS GOVERNED BY THE SEPARATELY SIGNED RENTAL AGREEMENT.

9. Indemnification

You agree to indemnify, defend and hold harmless HireAVac, its affiliates and personnel from any claims, damages, losses, liabilities and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, violation of these Terms, violation of any law, or infringement of any third-party right.

10. Third-Party Links

The Site may link to third-party websites (e.g., manufacturer datasheets, OSHA guidance, WhatsApp). We do not control and are not responsible for the content, privacy practices or availability of those sites.

11. Electronic Communications and Messaging

By providing your phone number or messaging us on WhatsApp, you consent to receive transactional and service-related messages (quote confirmations, trial reminders, delivery updates) from HireAVac. Standard message and data rates may apply. Reply STOP at any time to opt out of SMS; for WhatsApp, you can block our number or request removal via book@hireavac.com.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes constitutes acceptance.
